On April 5, in Hanoi, the Vietnam Union of Science and Technology Associations (VUSTA) held a consultation workshop to give opinions on the draft revision of the Law on Education. Mr. Nghiem Vu Khai - Vice President of the VUSTA and Mr. Pham Tat Thang - Vice Chairman of the National Assembly Committee for Culture, Education, Youth, Adolescents and Children co-chaired the workshop.

In December 2018 and January 2019, VUSTA has organized two workshops to comment on the revised Education Law and acquired a number of ideas, opinions and comments from participants. However, there were still some articles need to be amended, supplemented and clarified to ensure the Law Bill further improved.

According to Mr. Nguyen Minh Thuyet - Member of the National Council for Education and Human Resources Development, Article 1 should be amended as follows "The Education Law regulates the national education system; schools and other educational institutions; teachers, learners; rights and responsibilities of organizations and individuals engages in educational activities; rights and responsibilities of family and society for educational activities, State management on education”. In Articles 2, overlapped words and phrases should be expunged, in particular, choosing one phrase between "with national spirit and patriotism" and "persistence in the ideal of national independence in association with socialism"; removing the phrase "forming and developing personality, quality and capacity of citizens", because it was similar meaning with "morality, knowledge, aesthetic and vocational competence".

At the workshop, participants also provided many comments such as the common goals of education in general,  primary education, secondary and higher education in particular are raising people's intellectual standards, training human resources, fostering talents, developing Vietnamese people with morality, knowledge, health, aesthetic and vocational competence, persistent in the ideal of national independence and socialism, promoting the potentials and creativity of each individual to meet his own development needs and the requirements of the cause of the Nation’s development and defense. The participants agreed that these levels of education only differ from each other at the level of achieving common goals, not the nature. These levels of education are not the relevant criteria to define level of autonomy of the education institutions.

Regarding textbooks, secondary education establishments are entitled to choose textbooks. In the future, these institutions may develop their own textbooks. As such, there is no difference to higher education institutions.

In terms of the school council, the regulations in the draft of the Law are basically the same the current regulations. For public schools, the school councils only play a formalistic role if the relationship with the party committee has not been solved. It should appoint party secretary or party secretary as the school council. In addition to the rights stipulated in the draft Law, the school council has rights to elect and/or to dismiss the principal; approve results of election, results of the vote of confidence for principals; approve or dismiss the vice principal based on the principal's proposal or the results of the vote of confidence when necessary.

For non-profit private schools including foreign-invested schools, it should not be regulated the elected investor or decided by contributed capital ratio. That such regulations are similar to private schools or in other words similar to enterprises. For enterprises model, they elect representatives of investors in the board of director equivalent to their capital contribution ratio; board of directors is responsible to organize the implementation of tasks which are under the deciding and approving of shareholders. The decisions also have been made followed by the capital contribution equivalent of shareholders.

A number of delegates gave comments to the Draft Education Law, which will be synthesized by VUSTA and submit to the National Assembly.
