VUSTA organizes the dissemination of the Press Law 2016

On March 31, at the head quarters at No. 53 Nguyen Du, Hanoi, the Vietnam Union of Science and Technology Associations (VUSTA) organized the Workshop on Dissemination of Press Law 2016 to press agencies in VUSTA system. Attending the Workshop were VUSTA Vice President Phan Tung Mau, Deputy Director of Authority of Press, Ministry of Information and Communication Nguyen Van Hieu, leaders of press agencies and science and technology organizations of VUSTA.

In his opening speech, Mr. Phan Tung Mau – VUSTA Vice President stressed that the Press Law 2016 will be an important legal corridor with a lot of advanced new provisions in line with the practical life of journalism and journalistic work, serving as a solid and concrete legal foundation for the development of journalism in the coming period. The Press Law 2016 has overcome shortcomings that are no longer suitable with the reality of the previous Press Law. Through this workshop, leaders of VUSTA press agencies attending the workshop will carefully research on the contents, discuss and exchange unclear matters in order to reach an agreement in implementation, dissemination, and thoroughly understand the contents at their own newspaper houses.

Right after that, Mr. Nguyen Van Hieu, Deputy Director of Authority of Press, Ministry of Information and Communication, specifically introduced the Press Law 2016 to the attendants with a number of basic contents as follows:

Freedom of the press, freedom of speechon the press of citizens. Accordingly, citizens have the right to create press works, to provide information to the press, to respond to information in the press, to access press information, to associate with press agencies to make press products and to print and publish printed newspapers.

At the same time, the new Press Law also added a number of subjects permitted to establish scientific journals such as: higher education institutions in accordance with the Law on Higher Education; scientific research organizations, scientific research and technological development organizations organized in the form of academies and institutes in accordance with the Law on Science and Technology; and hospitals of central or provincial level or equivalent.

Another noteworthy point is that the new Press Law has supplemented the provisions on association in the press, which used to beincluded in the circular of the Ministry regulating association in the production of radio and television programs.

Association in the press is specified in terms of the fields and contents that press agencies are allowed to associate with other press agencies, legal persons and individuals having business registration suitable to the associated field; the maximum duration for association in radio channel, television channel to serve political tasks and essential propaganda information as required and the general news – politics channel; the maximum duration for radio and television agencies to associate in production of the entire radio and television channels.

Regarding the right to practice journalism, the new Press Law also specifies the responsibility for providing information to the press of agencies, organizations and persons in charge; information that competent agencies, organizations and individuals may refuse to supply to the press. At the same time, it also stipulates that press agencies and journalists only have to disclose the information providers at the written request of the Chairman of the People’s Procuracy, the Chef Justice of the provincial People’s Court and equivalent or higher where it is necessary for the investigation and adjudication of very serious, particularly serious crimes.

The rights and obligations of journalists are also supplemented and legalized with respect to compulsory provisions on professional ethics of journalists. The Press Law stipulates that the Vietnam Journalists Association has the duty to promulgate and organize the observance of regulations on professional ethics of journalists; journalists are obliged to comply with regulations on professional ethics of journalists and will be subject to withdrawal of journalists’ cards where the violations of professional ethics cause serious consequences.

Service business of press agencies are also specified more openly with regulations on revenue sources of press agencies including revenues from business activities, services of press agencies and their subordinated units.

Prohibited acts in press activities in the new Press Law are compatible with the provisions of the Criminal Code 2015, and other prohibited acts are compatible with the Civil Code and other laws to ensure practical feasibility.

In particular, the new Press Law has added a number of new provisions on the rectification and handling of violations. For example, electronic newspapers, in addition to posting of correction and apology, also have to remove false information that has been posted. Press agencies and general websites that have published or posted information of other press agencies, including information subject to correction and apology must also post such correction and apology the violating press agencies. At the same time, the law specifies positions of rectification for each type of press.

In addition, the new Press Law has also codified the provisions of the Government’s Decrees to include in the law such as the State policy on press development; change of the governing body of press agency; cooperation of the Vietnamese press with foreign press; press activities of foreign press, foreign representative offices, and foreign organizations in Vietnam; protection of the content of radio, television programs, electronic newspapers; and feedback information.
