On 10 April 2018, in Hanoi, the Vietnam Union of Science and Technology Associations (VUSTA) organized the workshop on the draft of development Strategy of intellectual property activities for the period 2018-2030. Dr. Pham Van Tan - Vice President cum Secretary General of VUSTA and Dr. Phan Tung Mau - Vice President of VUSTA presided over the workshop.

According to Mr. Nguyen Van Bay - Head of Legal and Policy Department, National Office of Intellectual Property, Ministry of Science and Technology (MoST), Vietnam has built a relatively complete institutional system on related issues of intellectual property, including laws, decrees, circulars.

In the process of developing market economy and international integration, intellectual property plays an increasingly important role. Therefore, the Government assigned MoST to develop the "National Intellectual Property Development Strategy". This strategy sets out objectives, methods and solutions to contribute to socio-economic development in general and to the intellectual property sector in particular.

The National Intellectual Property Development Strategy consists of three main areas: the guiding principles and general objectives of the intellectual property system; specific strategic objectives up to 2030; and strategic tasks.

The Strategy also sets a specific target until 2030, including: Putting the intellectual property system into a key tool for promoting innovation, creating intellectual property, contributing to respond the need of new and innovative products, especially endogenous technology for the industries development.

In terms of enhancing the efficiency of intellectual property rights acquisition, the system of intellectual property rights will be upgraded into modern and user-friendly public administrative service system, mainly for industrial property rights and plant variety rights.

On the breakthrough effect of intellectual property rights protection, the organization and protection of intellectual property rights (IPR) will be strengthened in accordance with the nature of the civil, administrative and criminal mechanisms in order to achieve high efficiency in the fight against IPR infringement, especially anti-counterfeiting of intellectual property.

Intellectual property will be made as one of the most important resources in the growth of businesses and the economy by promoting the exploitation of intellectual property.

Specifically, the strategy also sets out specific tasks to be implemented through the implementation of projects and programs, including the Project on the completion of policies on intellectual property law to meet the needs of economic and social development and integration; Project on professional human resource development on intellectual property; Project on enhancing the capability of exploiting technology information of intellectual property; Program on Intellectual Property Development Assistance; The scheme on mobilization of social resources in service of State management on intellectual property along the direction of socializing some services.

According to Dr. Nguyen Manh Hung, Vice President of Vietnam Standards and Consumer Protection Association, the project has not assessed the real intellectual products of the society. Many innovations are in fact intellectual property of the collective, individuals which have been invented, even applied in practice, but for some reason, such as the inventers do not aware of the importance of IP or do not know how to complete registration procedures, so they are not be granted patents or certificates of protection and are not included in the monitoring and statistics system of management agencies.

Dr. Nguyen Vi Khai - Deputy Director of Institute for Development Issues

According to Dr. Nguyen Vi Khai - Deputy Director of Institute for Development Issues, the whole content of Strategy is transferred to 99% from structure, language to expressions, issues of the project. This is a problem of the drafting technique that needs to be reviewed because the wording of the legal documents can not be so simple (13 pages). The project can be long interpreted for analysis, evidence, description, listing ... In contrast, words in legal documents requires precise filtering, in which conception and meaning should be not vague. Structure of the document should be reviewed because the document has only 3 articles, article 1 is too long (12 pages), article 2 has only 1 line.

Dr. Dang Ngoc Dinh, director of the Center for Development Research and Community Support, sadi that it is necessary to better reflect the challenges and requirements of the current context. Based on shortcomings, challenges and requirements from the current status, the drafting team should clarify some concepts of the Strategy which are vague. For example, the concept "enhance awareness to shape the practice of respecting intellectual property rights”; or "international integration, overcoming the challenge of intellectual property"; or "recognize the importance of intellectual property in the 4.0 industry"; v. v.  At the same time, more effort should made to consolidate overlapping or unclear points of view.

In terms of solutions, we should think and propose a breakthrough, dynamic solution to implement the Strategy effectively, Dr. Dinh said.

According to Dr. Truong Quang Can - Vietnam Water Resources Development Association, it is necessary to synthesize comprehensive data on intellectual property activities of Vietnam now, on that basis, we can compare with other countries in ASEAN region to strive to 2030, Vietnam can be classed in the first group of the region.

At the workshop, the delegates as appreciated that the Strategy draft was carefully prepared, elaborated with relevant analysis and relatively strong argument. However, in general, the content of the Strategy is still "traditional" but there is not "highlights" that reflect the characteristics and requirements of the current domestic and international context, especially in the sections about the policy guidance and breakthrough solutions.
