Decision No 650/QD-TTg, 24th April 2006 of the Prime Minister of the Socialist Republic of Vietnam

On April 24th 2006, the Prime Minister Phan Van Khai signed the Decision n°650/QD-TTg approving the Regulations of Vietnam Union of S-T Associations (amended) adopted on December 28th 2004 by the National Congress of Representatives, Vth, of the Vietnam Union of S-T Associations. The Regulations shall be valid in 15 days after the date of Decision signing. Hereinafter the integral text of the Regulations.

Approval of the Regulations of the Vietnam Union of

Science and Technology Associations (VUSTA) 

THE PRIME MINISTER

Basing on the Law of government Organisation December 25th 2001;

Basing on the Report of result from the National Congress of Representatives of the Vietnam Union of Science and Technology Associations, Vth round, in December 27th and 28th 2004;

As per proposal by the Central Council Chairman of the Vietnam Union of Science and Technology Associations,

DECIDED:

Article 1. To approve the Regulations of the Vietnam Union of Science and Technology Associations (amended) adopted by the National Congress of Representatives, Vth round, of the Vietnam Union of Science and Technology Associations on December 28th 2004 (issued jointly with this Decision).

Article 2. This Decision shall be valid after 15 days, counting from the date of publication on the Official Gazette.

Article 3. The Ministers, the Heads of ministerial level bodies, the Heads of governmental organs, the Chair persons of People’s Committees of provinces, of centrally affiliated cities, the Central council Chairman of VUSTA are responsible for the implementation of this Decision.

REGULATIONS

Vietnam Union of Science and Technology Associations

(Issued jointly with Decision n° 650/QD-TTg

dated April 24th 2006 of the Prime Minister)

During the long historic process of national defense and building, the Vietnamese intelligentsia always uphold a lofty patriotic spirit, a national pride for unceasingly endeavouring, sacrificing, enthusiastically building the great national solidarity, contributing effectively to the noble cause of our revolution up to successive victories.

Since the mid XXth century, many Vietnamese scientists’ associations had been successively established. On the basis of activities’ results by the provisional liaison Committee of Vietnam science and technique Associations, in March 26th 1983, at Hanoi, the representatives of 14 central Science & Technique Associations and the Hanoi Union of Science & Technique Associations had organised the Congress for establishing the Vietnam Union of Science & Technique Associations.

Since its establishment until now, the Vietnam Union of Science & Technique Associations had been unceasingly consolidated and developed, deserving to be a socio-political organisation of the national contingent of scientific and technological intellects.

Chapter I

PRINCIPLE LINE, OBJECTIVE & GENERAL STIPULATIONS

Article 1. The Vietnam Union of Science and Technology Associations (VUSTA for short) is a socio-political organisation of the national contingent of science and technique intellects. VUSTA is organised and operates according to the principle of free will, democracy and solidarity.

VUSTA is a member of the Vietnam Fatherland Front.

Article 2. The objective of VUSTA is to enhance the spiritual potentialities of scientific and technological intellects’ contingent for serving the cause of national industrialization and modernization, of building and defending the Fatherland, for contributing to the implementation of the overall objectives: affluent people, powerful nation, equitable, democratic and civilized society.

Article 3. VUSTA, in its activities, abides by Regulations adopted by the National Congress of Representatives. VUSTA’s Regulations are in accordance with the Law of the Socialist Republic of Vietnam.

Article 4. VUSTA deploys its activities on the national scale, with the headquarter in Hanoi, and could set up its permanent organs in some localities according to legal prescription.

VUSTA has got juridical entity rights, its staff, seal, properties, financial account, press organ and its own publishing house. The establishment of press organ and publishing house is implemented according to the law.

Chapter II

FUNCTION and TASKS

Article 5. VUSTA has got the following functions:

1. Grouping, uniting the contingent of scientific, technological intellects at home and of overseas Vietnamese; co-ordinating the activities of member Associations.

2. Acting as a clue/liaison base between member Associations and organs of the Party, the Government, the Vietnam Fatherland Front and other institutions for dealing with common issues in VUSTA activities.

3. Representing, protecting legitimate rights and interests of its members, its member Associations, of scientific and technological intellects of Vietnam.

Article 6. VUSTA has got the following tasks:

1. Consolidating, developing organisation and promoting activities of member Associations.

2. Participating in the socialisation of activities in science and technology, education and training, people’s health care, community development, famine eradication, poverty alleviation:

a) Improving professional level for cadres participating in associations’ activities, diffusing science and technology knowledge to people; organising and guiding mass movement in the march forward science and technology.

b) Organising activities in consulting, criticising and society appraising for contributing to building scientific basis in the fixing of programmes, plans, directives, policies of the Party and Government on socio-economic development, on science and technology, education and training, environment protection, law building, national security and defense strengthening; participating in independent control/supervision versus important projects/works.

c) Organising scientific research and technology development, transfer of scientific and technological progresses to production, life and environment protection.

d) Participating in the organisation of activities in education, training and vocation, contributing to the building of a learning society, the improvement of people’s intellectual standard, the training of human resources, the nurture of talents.

đ) Participating in activities for community development, famine eradication, poverty alleviation and people’s health care.

3. Implementing the active mobilization of science and technology intellectuals:

a) Enhancing patriotic traditions, national pride, citizens’ responsibilities, cooperation spirit, community behaviour, honesty and professional ethics.

b) Propagating, widely diffusing Party and Government lines, directives, policies and law.

c) Mobilizing overseas Vietnamese science and technology intellectuals to participate in the cause of Fatherland building and defending.

d) Creating conditions for the improvement of professional level, contributing to the improvement of spiritual and material life of scientific and technological workers.

4. Duly playing the role of a member of the Vietnam Fatherland Front:

a) Co-operating with other member organisations of the Vietnam Fatherland Front to deploy common activities for stimulating the combined strength and building the great national solidarity bloc.

b) Reflecting the aspirations and ideas contributed by scientist - technologists’ contingent to the Party, the Government and the Vietnam Fatherland Front.

c) Participating in the struggle for peace, against war, for friendship, comprehension and co-operation among nationalities.

5. Reinforcing the cooperation with other countries’ associations, NGOs, participating in regional and international science and technology organisations as per legal prescriptions.

Chapter III

MEMBER ASSOCIATIONS

Article 7. The member Associations of VUSTA are Associations, Federations with legitimate activities in different fields of social and human sciences, natural sciences and technological sciences (generally called central branch associations), and Union of Science & Technique Associations of provinces and centrally affiliated cities (generally called local Union of Associations).

Central Branch Associations are established according to Decisions by competent state administration bodies, with activities nation wide.

Local Unions are established according to Decisions by People’s Committees of Provinces or centrally affiliated Cities, and are members of VUSTA. Local Unions have got members as local branch Associations being established as per legal prescriptions.

Article 8. Member Associations have got autonomous rights, are self - administered, with regulations or own rules on organisation and activities in accordance with regulations of VUSTA, and put under the steering, control of VUSTA Central Council Presidium concerning the implementation of VUSTA Regulations.

Article 9. Rights of member Associations:

1. Participating in discussion and decision on general directives of VUSTA.

2. Enjoying favourable conditions created by VUSTA in the activities of Associations.

3. Participating in various organisations and activities of VUSTA.

4. Enjoying the rights prescribed by VUSTA.

5. Having the right to withdraw from VUSTA when there is resolution by Association’s Congress for so doing.

Article 10. Obligations of member Associations:

1. Abiding by the Regulations of VUSTA and implementing the resolution of VUSTA Central Council.

2. Unceasingly enlarging the influence and rising the prestige of VUSTA, mobilising members to respond positively to activities of VUSTA.

3. Reinforcing the solidarity of VUSTA, mutually supporting and collaborating in activities.

4. Contributing to VUSTA activities according to stipulations by VUSTA Central Council.

Chapter IV

LEADING ORGAN OF VUSTA

Article 11. The leading organ of VUSTA is elected and deploys its activities according to principles of democracy, collective leadership, individual responsibility, majority decision.

Article 12. The supreme leading organ of VUSTA is the National Congress of Representatives of VUSTA.

The Congress’ regular meeting is held once for 5 years, and when there is requirement by over a half of member associations, an irregular meeting could be convoked.

The number  and composition structure of representatives participating in the congress shall be stipulated by VUSTA Central Council.

Article 13. The National Congress of Representatives of VUSTA is assigned with tasks as follows:

1. Approving the recapitulative report of VUSTA Central Council on situation and results on activities of VUSTA in the past term; deciding on orientative activities of VUSTA in the subsequent term.

2. Discussing and voting for the amendment, supplement of VUSTA Regulations.

3. Electing the Central Council of VUSTA.

Article 14. The composition of VUSTA Central Council comprises representatives of all member Associations and some members introduced by the preceding Presidium, which number doesn’t exceed 15% of the total members of VUSTA Central Council.

The Central Council of VUSTA holds a regular meeting once a year and could convoke an irregular one by requirement of the Presidium or of over a half of VUSTA Central Council members.

Article 15. VUSTA Central Council is assigned with the task of organizing the implementation of Resolutions by the VUSTA National Congress of Representatives, and steering all activities of VUSTA in the interval of two congress terms.

Article 16. The VUSTA Central Council has the right of deciding on its organisation structure and its activities, on the acceptance of new member associations; on supplementing, changing, sacking members of VUSTA Central Council; on steering, controlling activities of member associations and dealing with issues/problems according to proposals by the Presidium.

Article 17. The VUSTA Central Council elects the Presidium. The Presidium comprises Chairman, Vice Chairmen, Secretary General and some members. The procedure for electing the Presidium is decided by VUSTA Central Council.

The Presidium, on behalf of VUSTA Central Council, steers and supervises all activities of VUSTA in between two meeting sessions of VUSTA Central Council. The Presidium assigns some members for assuming standing functions.

Activities of the Presidium and specific tasks of members are stipulated in the activity statute of the Presidium.

The Presidium holds regular meeting once in three months. The Chairman has the right to convoke irregular meetings of the Presidium.

Article 18. The Presidium establishes and stipulates the functions, tasks of VUSTA Central organs, of specialized councils and affiliated organisations. The establishment of affiliated organisation is implemented as per legal prescriptions.

Article 19. The VUSTA Central Council elects the Control Committee of VUSTA, with rights and tasks as follows:

1. To control when and where there is sign of infringement on activities’ statutes of VUSTA, of member Associations and of affiliated organisations.

2. To guide and direct activities of Control Boards of member Associations.

3. To examine and deal with petition, denouncing letters.

Article 20. The structure, number of members and procedure for electing the VUSTA Control Committee are determined by VUSTA Central Council.

The President of the Control Committee is a member of the Presidium of Central Council of VUSTA.

The Control Committee holds its regular meeting once in three months, and could hold irregular meeting as per proposal by the Chairman of VUSTA Central Council or the President of the Control Committee.

Chapter V

FINANCE AND PROPERTIES

Article 21. The financial source of VUSTA comprises:

1. Government Financing;

2. Expenditure for implementing the tasks assigned by Government organs;

3. Contribution by member Associations and affiliated organisations;

4. Aid by money or by goods in nature from individuals, organisations at home and abroad;

5. Other legitimate sources of income.

Article 22. Finance and properties of VUSTA are managed and utilized according to stipulations by the Presidium of VUSTA Central Council and to current stipulations of the Government.

Article 23. VUSTA could set up various budget funds. The setting up and activities of such budget funds abide by the law.

Chapter VI

PRAISE and DISCIPLINE

Article 24. Member Associations, affiliated organisations and members with meritorious achievements in association’s work shall be praised by VUSTA or proposed to be rewarded by the Government.

The form of praise or reward is stipulated by VUSTA Central Council.

Article 25. Member Associations, affiliated organisation and members violating the Regulations of VUSTA shall be sentenced. The form of sentence is stipulated by VUSTA Central Council.

Chapter VII

PROVISION OF IMPLEMENTATION

Article 26. These Regulations comprise 7 chapters, 26 articles, had been adopted by the National Congress of Representatives of VUSTA, Vth round in December 28th 2004, for replacing the Regulations of VUSTA adopted by the National Congress of Representatives of VUSTA, IV round in January 9th 1999.

The National Congress of Representatives of VUSTA is solely empowered with the right of amending, supplementing these Regulations.
